Faced with a dilima in Colorado:

My husband and I moved into an apartment complex going on 6 months ago and for the first month we had no problems what so ever. But after about 2 months we started haveing major problems with the renters above us. They Are constantly blasting loud music and are constantly haveing major parties upstairs. This type of thing goes on at all hours of the day and night. We have two babies, and we are realy tired of them not being able to go to sleep at night or even down for an afternoon nap because the noise is so loud that it wakes them up. My babies are only 3 years and 5 months old. And we have constantly reported this to our landlords and at first they told us to call the local police department and we did that and that didn't seem to work so we talked to our landlords again and they told us that there is nothing that they can do about this. So we are still haveing to put up with all of this noise . In fact there was a recent incident that happened just a week ago that the people upstairs started haveing another party at 4:00 a.m. and it woke all of my family and when we went to talk to the landlord and again all they said to us is we are sorry but we can't do a thing about it. We have a year lease and we do not want to stay there any longer than we have to , so please tell us what can we do? Can the landlord really not do anything?

Send a certified letter to the landlord documenting the noise and the police complaints, do you have the bulding managers home phone or the supers? well call them at 4 AM and complain.

tell them in the letter you are going to withold the rent untill the noise stops or the tenants are evcited..OR as an alternative that you will use your security as the last months rent and you will be out in 30 days, and that the lease is effectively terminated as of Feb 28th, and that the landlord agrees that all monies have been paid in full to satsify the lease requirments ( so they cant sue you for damages later)

Make sure you send them 2 copies with spaces for them to sign.

That should get their attention
