breaking court order

okay here is the story :
my boyfriend ex girlfriend overdosed on drugs and lost custody of her 3 children. 1 of those children being my boyfriends daughter and the other two children their father was living with her at the time and also doing drugs. So they take away the kids put them all in foster homes, and will not give my boyfriend his daughter unless he completed drug testing for 3 months, parenting classes and a physcological eval. now the other father was supposed to complete these things as well but he never did. Now my boyfriend never had any problems with drugs or parenting but obviously the other father did, the other father has beaten the children and used drugs in front of them. Ok.. so in the court report it states that both the mom, and the father (my boyfriend) completed everything that was asked of them by the court and the children were returned to the mom and my boyfriend has his vistits with his daughter, but.. in the court report it also states that the father of the other 2 children cannot see these kids unless it is supervised becasue he never completed anything that was asked of him. 2 days ago my boyfriend found out that this man is the one dropping his daughter as well as the other 2 kids off at daycare in the morning. (this man is not supposed to be around them unsupervised) SO my question is .. is this breaking court order and he has called his case worker to report that he feels his daughter is in danger and she stated she already knew this was going on and warned the mom not to have the other man around. But my boyfriend does not want his daughter or even the other 2 kids he raised around this drug crazed, abusive man. What can he do to request a emergency court hearing????? PLEASE HELP! He has a lawyer but she works for Child Protective Services and seems to busy to ever get in contact with him and the case manager seems to be on mom's side when she is supposed to be looking out for the best interest of his 3 yr old little girl :confused:

Take the mom

To court for contempt and fight for full physical custody of your child

Also file a complaint with the case workers supervisor and tell him if something is not done that you will file a complaint with his supervisor and so on down the line.

Has b/f provided daycare with a copy of the court order? He should...usually you have to sign children into daycare. I would advise Dad request the daycare records & prove the child is in the b/f's care.

Dad can take that information &/or any other documentation or evidence ...file in court against Mom for contempt, &/or change in custody. He should address his concerns for the safety/welfare of his daughter. Dad needs to get the daycare records to the attorney & Call & Call & Call until there is action.

WEll we are in the process of doing this, he has called the daycare and they are stating they cannot release information to him they need him to have his lawyer (whom he can't get a hold of) we have sat on her steps waiting for her to come in to work and still nothing. This really is upseting becasue he has done everything asked of him although it was degrading as so forth but his daughter at the age of 3 is way to young for this and if this man beat thses children before and is a known drug user I don't understand why the case manager let this go on! We talked with her supervisor today and she was not aware of anything that was going on with this other man! I am just so ready to scream at this court system I am a woman and have been told that Arizona is a woman's state but I never in my life thought that it was this bad, they are more worried about making excuses for this crazed mom and other dad and not wanting to have more problems!!!
