we live in illinois and want to break our lease one month early but our landlord is telling us that we must supply 30 days notice and pay 2 months rent. we are willing to give them 60 days notice before we move out. there is no clause about penalties for breaking our lease in the lease that we signed. when i asked the leasing agent about this, i was told that this clause is not included in our copy of the lease but that they have a copy of it in the office. she also told me that we were not required to sign this addition to our lease. do we have any bargaining ground for breaking our lease without penalties.

Of course you know what the landlord is doing is ILLEGAL.

You ARE required to sign any and ALL doucmnets to the lease, so give them 30 days notice, and of course they will NOT give you back your security deposit, even if you do a final walk thru...

So you will have to sue them in small claims court for your money back, and they will probably sue you too..

Of course if you dont show up for court they will get a judgemnet against you.

So how far are you moving?
