We are in Pennsylvania. My girlfriend rented a room in an older lady's condo for a year long lease. We are four months into the lease and she wants to move out b/c the lady is crazy. The lease specifically states, "If this lease is broken by my girlfriend, she understands that she may lose her Security Deposit, barring extenuating circumstances." We are concerned about this lady taking my girlfriend to court to continue rent payments each month until she can find a new tenant. I believe that Pennsylvania state law allows for this, but that this contract takes precedence and because she only says that she will lose the security deposit, the landlord can take no further action against my girlfriend. Does a contract take precedence over the law and can this lady sue my girlfriend for breaking the lease?

Lets try this;

the landlord has a duty to mitigate damages.. She has to advertise the room as soon as you moved out, show it, or make a good faith attempt to rent it at the SAME RENT you are paying.

Because it is ILLEGAL to let property sit empty or to try and charge say 50% more rent, then sue you a few months later saying no one rented it and you are liable for the rent.

That would be your defense...

Well you can do what you want

You can do what ever you think is best but I wouldn't take advice fro some one thatgets her kick by tring to belittle other people and their problems. She replyed to my question with contempt and hateful disreguard for my feelings or problem. she offered no advice only hate and bitchyness
