I am being threatened with a law suit by my 10 mo old son's former daycare provider. I gave her 30 days written notice with the final check due for daycare to be performed in June My notice said that my son's last day in her care would be 6/30. On 6/2 she was verbally hostile toward me in the presence of my son to such a degree that I realized I could not leave my son with her. She retaliated against my son by changing his diet (from table food back to jarred baby food) as a result of her anger with me for giving notice and she instructed me to remove my frozen milk which we were keeping in her freezer permanently as a back up to the fresh supply. These actions, in my opinion, made it impossible for me to leave him with her for the final 30 days of the contract and I missed 2 days at work scrambling to find alternative daycare. Her instructions for me to remove my frozen milk indicated that she did not intend to continue taking care of him. I cancelled payment of the check (1,100 dollars) as I cannot afford to pay 2 day care providers at once. Will I be able to defend myself in a law suit if she sues?. Her contract stipulated 30 days notice. I would appreciate knowledgeable opinions. thanks.
