Breech of Contract/Fraud of My Marriage

I had a wedding ceremony in June 2000. I found out the man who performed the ceremony was a fraud and my marriage was not legal and had to have another ceremony. I have since hired an attorney and he said we will sue for breech of contract and fraud.
My attorney tried contactin the man who performed ceremony by mail in December and never received a reply. I have no idea if my attorney has filed against this man. I'm in the state of California. Is their a time limit to when this must be filed in the courts? Someone told me a suit must be filed within one year. Time is running out. Should I contact attorney and see what's going on? I would appreciate any advice. This has been a complete nightmare. Thank you

Woa little filly - - slow down ! Take it easy, sit back, take a deep breath and calm down; you're going to be just fine.

You've been given really bad information. True, there is a one year Statute of Limitations - - but that's for "bodily injury" claims, like those you might sustain and suffer from a car accident, or slip, trip and fall type accident.

Your case, however, is founded on the Cause of Action called Civil Fraud. In California, fraud which is based upon a writing (the marriage certificate), and has a 4 year Statute of Limitations. So, you and your attorney have plenty of time to file your lawsuit.

It's always a good idea to call your attorney every now and again if, for nothing else, just to get an update. But, your attorney knows the controlling Statute of Limitations and will do all that is necessary to help you exercise your Rights.
