Stud contract in NC. Contract called for owner of female to provide me with medical records, test records and photographs. Breeding took place without this obligation being fulfilled based on verbal promise of owner of female to get the info a.s.a.p. Owner never provided it, but service was rendered. Stud fee was collected. Owner of female said dog was "in labor" right before Christmas. Week later, she said there weren't any puppies; dog had "false labor". Talked to two vets, "false labor" never heard of. False pregnancy, yes, but not labor. Now the owner is sueing me in court to get the stud fee back saying there weren't any puppies. Gave me false certification which belonged to parents of female being bred instead of the females certification. Appears she gave me a false address as her residence. Wouldn't let me see the female at the time she was pregnant. Has waited until the female would be back to normal and all puppies would be weaned and gone to file lawsuit. What should I do? Since she was in breech of our contract from the very beginning, would I be under any obligation to give her the money back? She claims she was paying for puppies, but I told her in the beginning she was paying for the stud SERVICE. Contract was not clear cut enough. Help!!!!

What does the contract say about guarantees??
Who wrote the contract??? (Contract ambiguity goes against writer).
Does the contract offer 'repeat service' in the event of 'performance'??

Sounds like an honest disagreement. Get your information together and defend her claim. Court will decide who's evidence is more credible.
