I was passenger in a car accident,where I was broadsided by a pick-up truck drivin by a 17 yr. old girl,We were attempting to make a right hand turn and apperently she didn't see us. And she was sited for the accident,As it turn's out she was driving her dad's truck off the lot of a car dealership that he own's. Anyhow I was carted off in the ambulance with pretty hefty upper body PAIN,once at the hospital went through the x-ray,cat scan ordeal.And they couldn't find anything later i was sent home with tylenol 3 w/ codein,I could hardly walk I was so sore, when I got home the pain progressively worse and I started having trouble breathing and my skin was gettin mushy as if there was air under my skin. So I called the ambulance for yet another ride when i was in the ambulance i had a blood pressuer of like 80 over a 100 when i arrived at the hospital i went through the x-ray ordeal AGAIN! Here it turns out i had a punctured lung...(Does the hospital hold any responseibilty for not keeping me for observation ?) So I spent a week in the hospital it has been about a month now since the accident and im still sore and her insurance company wants to talk dollars and cents as soon as I'm released from the doctor's care I know your going to say get legal help,but my ? is, Is the amount for pain and suffering goin to be worth getting an attorney, and futher more i don't want to wait years for a settlement!!!

Any advice would help...

Gee... 2 emergency trips to the hospital, an one week stay, emergency surgery to reinflate the lung, possible long term problems that haven't shown up yet..... GO HIRE A LAWYER!!! You've got a great case; don't screw it up by talking to anyone or trying to settle yourself. Can you say "Like a lamb to the slaughter?" Shoot I knew you could. :)

Don't try to settle this yourself, and don't expect a quick settlement. My old boss used to tell his clients that he wouldn't even think of settleing until they had been pain free and recovered for 6 months.
