What is the name of your state? IN
We broke a lease and are working out the terms. The house is owned by an individual but is managed by a Real Estate Company. Is it up to the owners on the terms or the REC and if we can't agree who decides to sue and does the sueing the owners or REC.

The entity that owns the real estate must sue unless you are leasing from another entity who has the authority to sue.

where would he file suit

If I would be sued does the landlord file suit in the state the house was leased or the state I'm living in now. The owner also lives in another state.
