The following scenario happened to us last weekend, and wanted to get an opinion about whether this is common practice and acceptable or if unethical.
I was with friends looking to buy a mobile home in a mobile home community. They had made an appointment to have a broker meet them to show several homes. They decided on one and said they wanted to write an offer. At that point, the broker told them that since the listing broker had taken the listing at 6%, rather than the usual 10% on this type of property, that they, the buyers, would be responsible to pay the broker the 4% difference she would miss out on.
I have held my real estate license in CA for 25 years and have never heard of this.
My friends decided to walk away and subsequently wrote the offer with an agent who was more than willing to accept the 6% commission. They feel the broker was untrustworthy and want to report her to the Department Of Real Estate.
I haven't sold real estate in 20 years, so maybe this is common practice and acceptable now, but it seemed at minimum unprofessional and potentially unethical.
Is this now common practice for selling agents to ask a buyer to make up any difference on a listing less than the "customary" commission?
