What is the name of your state? Tennessee
My broker only paid me 50% of the commission I earned on a closed sale this week.He said he decided to give 50% of my commission to my former partner for training me.There was never any contract or agreement to pay for training services. I worked as an assistant for about three months after real estate school. My ( former) broker also returned one entire commission to my former partner stating that the former partner did not have time to benefit from our agent/assistant relationship. I left that company and now I must decide if I should go to arbitration. what are my options and do I have a good chance of winning in arbitration? I signed a contract after I quit working with the partner saying we agree to hold each other harmless from our agent/assistant relationship forever and two months later this came up! thanks!

arbitration...

How is the arbitration being handled? By a mediator or your local association of Realtors?
It would be handled by the Board of Realtors (grievance panel).

**A: why would the answers to your questions be of relevance?
Because, although I'd like to think I'm right , maybe there is some rule that gives the broker the right to do what he did and I would be wasting my time in arbitration, besides.. the broker is the President of the local BOR, I would have to take it the other BOR we are memebers of. I have heard that taking a broker to arbitration is career suicide. I just can't let it go though, I mean in any other court (which we can't litigate between realtors) this would never be gotten away with. The other agent had no right to my commission, and though not alot of money to some, as a new agent I need the money. I thought that by signing the last agreement to hold each other harmless form our past agent/assistant relationship, I had no reason to be fianancially invovlved with the other agent again.

The Board of Realtors mediation panel does not get involved in company matters concerning payment of commissions to agents. Payment of commissions is a private matter beween the broker and the sales agent. The agent can take the matter to a regular mediation/arbitration panel outside the Board such as the AAA or litigate.
