Three trees are very close to a new lot, the roots of which grow well into the new driveway area. The excavation for the driveway has caused visible damage to the roots of these trees. Can the builder be held financially liable for damage to the trees? It may take several years for the trees to die. Can he be required to protect the trees/roots before any more damage is done?
