Bullying laws, daughter being harrassed

What is the name of your state?NJ

I have a situation where my daughter who is 10, is being bullied by another girl, who is older, but in another school(same school district).
Its only the third day of school, and this has happened twice since.
I have emailed the school which my daughter attends, and given a copy to the other school. We dont know the last name of the student, and given the fact that I am an adult I do not want to confront the minor for fear she may say I scared her, nor do I want to follow her home, I would get in trouble.
What should I do in this case. My daughter walks home by herself, and I will pick her up, but am afraid it may get a lot worse for her.
Can a report be made through a Police dept.?

I'm sure you understand the difficult nature of your problem. This does not fall under the bullying, harassment and intimidation laws that are being enacted by schools around the country. The bullying occurs as the students are walking home. Plus, you don't know the name of the student. There isn't much anyone can do without that information.

Is the girl attacking you daughter physically? If she is, the police might be a good response to demonstrate to your daughter that is the reason we have police.

I would suggest you continue to teach you daughter strategies when she is being harassed. Consider changing her walking patterns - have her spend 10 to 15 minutes at school after class is out to reduce the chance of bumping into each other. Talk to her parents. Good luck.
 
She could also ride a bike from school to home. The bully wouldn't be able to catch her unless she has a bike of her own.

I'm not a lawyer!

I'm not sure about the original poster's state/city but here in VA, the school's rules apply from the moment a student walks out of his/her front door until they re-enter that front door on any school day. I'm reasonably sure that that is how all school systems work, otherwise they wouldn't have any authority over truancy.

NJ 2002 New Jersey Laws, AB 1874, Requires each school district to adopt a policy prohibiting harassment, intimidation or bullying on school property, at a school-sponsored function or on a school bus.

The policy must include a definition of bullying behavior, consequences for engaging in such behavior, a procedure for investigation of reports of such behavior, a statement prohibiting retaliation or reprisal against persons reporting bullying behavior and consequences for making a false accusation.

Requires school employees, students or volunteers to report any incidents of bullying, intimidation and harassment to appropriate school officials. Grants immunity from any cause of action for damages arising from a failure to remedy the reported incident to persons reporting these incidents.

The bill was passed into law early last year. However, it helps you not one bit as the law only applies on school grounds.

Call the police and file a report of harassment against this brat.

You can file a police report in regards to Harrassment - stalking charges and they will either be arrested and/or served with a retraining order; however, you will need to know the child's full name etc...

This is under the Colorado Revised Statutes

18-9-111 Harassment - stalking

(1) A person commits harassment if, with intent to harass, annoy, or alarm another person he or she:

(a) Strikes, shoves, kicks, or otherwise touches a person or subjects physical contact; or
(b) In a public place directs obscene language or makes an obscene gesture to or at another person; or
(c) Follows a person in or about a public place; or
(h) Repeatedly insults, taunts, challenges, or makes communications offensively coarse language to another in a manner likely to provoke violent or disorderly responses

Mary, our poster is from New Jersey. I know you're trying to help, but it doesn't do any good posting statutes from a different state.

From New Jersey statutes:
2C:33-4. Harassment.

Except as provided in subsection e., a person commits a petty disorderly persons offense if, with purpose to harass another, he:

a.Makes, or causes to be made, a communication or communications anonymously or at extremely inconvenient hours, or in offensively coarse language, or any other manner likely to cause annoyance or alarm;

b.Subjects another to striking, kicking, shoving, or other offensive touching, or threatens to do so; or

c.Engages in any other course of alarming conduct or of repeatedly committed acts with purpose to alarm or seriously annoy such other person.

A communication under subsection a. may be deemed to have been made either at the place where it originated or at the place where it was received.

d.(Deleted by amendment, P.L.2001, c.443).

e.A person commits a crime of the fourth degree if, in committing an offense under this section, he was serving a term of imprisonment or was on parole or probation as the result of a conviction of any indictable offense under the laws of this State, any other state or the United States.

Also, get daughter an inexpensive disposable camera. Maybe she can snap a photo or two of this girl when she's not looking, which will help in identifying her.

Thank you for all the posts. They are all informative.
My daughter does have a camera phone, and I did not think of it, but putting the video on it during the confrontation she has with this girl will help with putting an end to this.
Today is the first day since I reported it to the schools, we will see.
I did take note of the rules for students to obey, and they indeed have to follow the same rules from the time they leave home untill they get home.
If it should happen again I will contact the police, since its happening in puplic.
