business claims customer equipment - legal?

What is the name of your state (only U.S. law)? CA

My friend left an LCD for repair at a store and didn't pick it up within 45 days. Now they claim that it is their property. The waiver he signed with the company when he dropped it off does say that equipment not claimed within 45 days becomes their property.

I want to research this further. Is there a California statute or case law that companies rely on regarding claiming ownership of property left by a customer for repair that is not picked up when customer is notified the repair is completed?

What these Cos. do is the equivalent of abandonment by the consumer .

Obviously the Co. put their labor time and parts into Items .

They will then sell them used to get back some of the losses .

Right, but again my question is, where is this referenced in law? There must be some case law somewhere.. or is there an "abandonment by consumer" law?
