We operate a restaurant in a town owned building. The lease was for 8 years with an option for 5 more. The original 8 years ends on 4-26-00. In order to excercise my 5 year option I had to make sure that all utility bills and property taxes were up to date. As these all are the only other condition of excercising the option are as follows. The following is exact wording in signed lease on renewal: "I have to notify in writing my intent to excerceise my 5 year option "within" 180 days of termination of lease". I notified the town in writing in January of 2000, of my intent to renew. The selectman denied me the renewal saying that I did not notify them in the alloted time of 180 days.We met with them at town meeting offering a new proposal on the next 5 years and they voted to stand by there original vote of 1/5/00 of not allowing me to renew.
I was not told of this meeting and there decision until after the fact. Please help as they are denying me my right to earn a living and we stand a real chance of losing everything as the restaurant is our source of income.
