I signed a contract w/ a trade magazine that I need to break. The trade magazine promised me that they would provide me w/ up to 6 different ads including layout & copy writing that would run in their popular trade show issues.
To make a long story short, the first ad they produced was amaturish at best. The ad was hard to read, and they forgot to include our contact info. I of course rejected the ad and I really just don't feel good about doing business with them.
The problem is that on the advertising contract they sent me to sign it says all advertising is non-cancelable. I haven't paid them yet, I don't have to pay until the first ad runs. They haven't produced another ad yet and the issues they promised to run my ad in will soon come off the presses.
How can I get out of this without getting sued? The contract is for $1100.00 and I am in CA.
