I recently purchased a Condo in Los Angeles. During Escrow-because of a fraud committed by my original morgage company I had to seek a new morgage company. I asked the Seller for more time. They gave me an additional two weeks. They asked me to sign a Per diem agreement which would make me responsible for $125 per day for every day past the two week period. I signed. To make a long story short they are billing me $1875 dollars in per diem costs. My question is that the sellers agent did not submit this per diem agreement into escrow so I never had the chance to negotiate, dispute or cancel the purchase of the property. I got notice a week after the close of escrow asking for the money. Do I have any legal ground to stand on? thanks th

What part of the agreement concerning the per diem do you not understand? You signed a contract, they billed you based on that contract and you do not owe it because...?

I am confused about what you feel is wrong. Sellers agreed to extend contract two weeks based upon a written agreement with you to pay a $125/daily "fee". So that is now being assessed to you. What is your disagreement?

So how many days AFTER the two week period did you end up closing? You owe them for those days. According to the math it took another 15 days after the two week extension.
