Please Advise. Seller is trying to intimidate my wife and I about the contract on her home. She is informing us that we are in default on the contract due to missing loan commitment deadline. According to the contract if we miss loan commitment deadline then we waive the right to back out of the contract with our earnest money. What it boils down to is she wants to sell her house for more money. I have spoken to several lawyers (consultation only) and they assure me my stand on the contract is correct. She appears to be refusing to sell the house. What is the next logical step. I know that it goes to mediation and then court, but how does one get the ball rolling, short of retaining a lawyer (which I intend to do if nothing else works.
