Buyer won't p/u vehicle ! Advice ?

Hello guys & gals. Need your advice.

I am in the state of Ohio. Sold a vehicle to a buyer in Florida. In the terms, I listed NO OUT OF STATE BUYERS because I didn't want to fool with a transport company. He bid anyway. I also listed transaction was to be completed in 3 days & vehicle picked up. I had to threaten to relist to finally get paid.

Here's the weird part. The guy won't p/u the vehicle ! First he was going to fly in, then he said a transport would p/u. His email & phone communication is weak at best. Very difficult to get any responses from this guy.

I agreed to store it for a few days until the transport came, but this is ridiculous ! I purchased a new vehicle that I would rather not leave out in the snow but the sold vehicle is being stored safely in my garage. I removed the tags & insurance so it can't be put on the street.

I am at my wit's end. I just want this vehicle out of here. Anyone have any idea what I should do ? I can tell you now before you mention it, I am not giving a refund & relisting the van. This has been a headache from day one & I am not going to put myself through it again.

They paid by bank wire to my account. $500 first. Then $2000 after I threatened to re-list if they didn't pay.

Sorry, I forgot to mention. I believe they got a bargain. 98 Chevy Astro Cargo van in very nice condition for $2500.00

Sorry you feel that I am no longer worth the effort & my responses aren't speedy enough for you. I don't babysit this computer. With a wife & two children, I have other things which demand my attention.

OK, try this: When was the end of the auction? How many days past the 3 you wanted for p/u have you gone? Comprende?

Now, send him an email or call him and tell him he is being charged $35/day for storage, and that doesn't include INSIDE storage. Find a place to put the van if you don't want it in your garage. Self storage with security is fine. If he doesn't pay the storage (your rates) he doesn't get the van.

I will tell you that auto shippers are sometimes hard to schedule, and no matter what they promise they can take weeks to pick up a vehicle.

What happened to the guy that babysits this forum & wants to badger those that do not ?

You're taking way too long to respond......obviously not worth my effort.

I'd like some real help here if possible. Not some jerk that wants to criticize me.

The auction ended 37 days ago. It has gone 34 days past.

Got it.

Jeez....folks are touchy here.

Anyway, you do have the right to charge for storage, but you really should have told him that at the beginning. You need to try one more time to see if he has a firm date for pick up. If he doesn't respond to your communications you still have to do your best to put him on notice that you are going to put the vehicle up for sale and he will be responsible for the storage and all fees/costs associated with selling it again. $2500 seems very cheap for your van, so your buyer must have some reasonable excuse for not picking it up. I'll bet the shipping cost is far more than he thought. I'll guesstimate around $1000-1,200 because of the higher fuel costs.

If you resell it you can deduct all your expenses, but you should keep the rest in an account in case he sues you for its return. He will have to sue in your state, so you'll want to do what you think is fair because it's unlikely he will come to OH to file suit. If you do sell the van you would be expected to mitigate your damages by considering what you get for the sale.
