i am in alabama and we are buying my inlaws house and would like to move in right away, however they have renters in the house with out a lease that don't want to move out. they were told at the first of the month to be out by the end of the month and just today they have called to say they won't be out by the 1st, what should we do?

My response:

1. Go to your nearest bookstore.

2. Buy book on Alabama Landlord / Tenant law.

3. Go back home.

4. Bring your in-laws over to the house. Serve coffee and donuts.

5. Show them book.

6. Let them read book.

7. Watch them "freak out" when they can't understand book.

8. Have them hire a "Landlord / Tenant" attorney.

9. Let attorney start the eviction process.

why must people be smart asses? anyway find out what the statutes are in your area and proceed with eviction. in new jersey there is a clause in which the person whom is buying the home should and can make sure the home is vacant at the time of sale for the purposes of living in the home. so, check into that and also it is still your in- laws responsibility to make sure that the tenants vacate if you have not closed on the house so make it a stipulation of agreement on the purchase of the house which honestly should have been done a long time ago.start eviction proceedings immediatly.

why are we smart assses?

Because most of the people who post here NEED to see and PAY for a LAWYER.....

But they are too cheap and lazy to do things legally......

we can give advice, but when people are like this and dont move out you have to take them to court, becuase if you lock them out throw their stuff out cut off their utilities like a lot of REDNECKS do...the tenant can sue for a lot of $$$ and can have the landlord arrested...

Sometimes it is just so obvious that you have to hire a lawyer.

You answered your own question about why i and many others think you are a smart ass. first of all i do not believe that many of these people need lawyers. what they need is to know their rights and study landlord tenant rights and laws. having a lawyer is great if you can afford them which some people may or not be able to do. but why would you be rude to someone because they havent run out and gotten a lawyer? and they cant be too lazy if they are trying to get advise now can they?

There really are 2 choices..

The woe is me. the tenant wont leave i dont have any money and cant afford to pay rent here and the tenant hasnt paid rent either what am i supposed to do?...... OR

The SOB is keeping me from moving into MY HOUSE...

You have to make a choice, and #2 requires a lawyer

(they actually Both require a lawyer but #2 will pay for one TOMORROW!)

apparently if you do not agree with the majority here you get insulted and degraded. it makes the people who want to help look bad. but half of these people are WRONG. so they need to make big posts to cover up their inadequisies. hey do you think this guy has issues or what? :)

My response: once again, incorrect information. Pursuant to State of Alabama law, in order to evict L must have a court order. Written notice must be first served upon the tenants. In this case, L did not give written notice to the tenants so therefore L is not in a position to evict.

My response:
Fact- I don't have to read the post because I remember that the writer stated "they were told at the first of the month." The key word here is TOLD. Pursuant to State Statutes, notice to vacate served upon the tenant must be in writing to be enforceable.
Therefore, the verbal notice that was given to the tenant means nothing. So you are WRONG again.
Also what is the frist of the month?
