If someone has already paid the down payment plus the first monthly payment on a mobile home,can the seller evict the buyer on a three day notice TO PAY RENT OR OUIT? Also,can the buyer sue for breach of contract in small claims court? HELP!!(CAlifornia)

You did not state if you are renting the land (as in a mobilehome park or buying the coach on deeded land. The question seems to mix purchasing (down payment on the MH) and a 3 day pay or quit (which is a rental violation) together. If you are purchasing the MH and do not pay the mortgage, then a Foreclosure notice would be appropriate. If you are buying the coach but it is in a Park where you must rent the land then yes, you have not paid the rent and a 3 day quit is appropriate. You may be mistaken about the buying of the mobilehome and the rent on the property. One does not fulfill the other.
