I live in a private lake development,we are incorporated,
have a board of directors elected by lot owners.We have ristrictions, voted in by members. my problem is, as a lot
owner, and voting member, how can I force the board to inforce the restrictions without a lot of legal expense.or require the board to pay my legal fees.

You can introduce a motion to enforce the restrictions. As for attorney fees, it has to be stated in the by-laws, amendments to, etc that the loser will pay all legal fees.

Thank-you Lawrat for your response. I have tried to get the board members to enforce the restrictions. My problem is one restriction concerning a piece of property next to me
the restriction reads "No sale of said lots shall be consummated without giving the owners of the (2) adjoining lots the first rights to obtain the property" The lot and home next to me sold and I was not notified,All property owners here on the development know the restrictions and they are recorded at the county courthouse, had the sale went through a realitor it would have been done different.
The board members contacted an attorney after I made a complaint, He sent me a letter, stating my only recourse is to hire an Attorney. Why do I have to hire an Attorney to enforse the restrictions? I feel thats why we elected the board of directors. And voted on the restrictions.
Please advise.
