I am having difficulty finding an answer to a question pertaining to custody time in california. Q: we are in califfornia. we have 50/50 joint custody of our child. is custody time counted per night (overnight) or per day (leaving at 6pm)??
background for this question: there was an agreement implemented seven years ago that son is to stay with one parent no more than 14 days in a row. because of the holiday schedule mom has manipulated the agreement by son interpretting our son being with us at 3pm and leaving three hours later (this one afternoon is within a 17 day period of time) and claiming this is a waiver of the no more than two-week agreement, and just didn't return him home. we are still waiting. we could not go and get him because she took him out of state (didn't find out until it was to late). i know most states consider overnight as a custody day, but is anyone familiar with the 'california' law in this matter?
