i live in CA. on a ranch with a driveway easement, the land
owners that use the driveway don't like gates they want to install a cattle guard , would they be responsible for the maintenance {cleaning out} & livestock loss, & cost of instillation ?

does the easement grant or other creating document say anything to cattle control methods? Does it allow for a gate? cattle crossing? anything? does it prohibit any of the previous?

not that i am a where of, if its the neighbor idea to put a cattle guard in i guess a agreement should be written to replace the gate with a cattle guard ?

You should first review the creating instrument. It may provide support for your argument or it may defeat your argument. No sense in arguing a point when you don't have all the facts.


Of course, if you can get them to agree to your position, there would be nothing wrong with doing that. Make sure it is written. If there is anything you wish to carry on to any subsequent owners of the other property, you need to attach it to your deed as well.
