HELP! Need rental contract laws for CA
two related problems:
A friend's boyfriend went to jail leaving her alone and disabled(recent spinal surgery). I agreed to let her stay my place, for 3 month trial,although she wanted a six month lease. Land lords gave verbal agreement for sub rent, friend never signed an agreement with me or landlord. two verbally agreed upon requirments, have positive attitude and boyfriend was not allowed near property. I gave her the first month ,$400, on loan. She has paid each of the last two months on time.
The trial period was more than enough. she leaves notes such as, "gone for the weekend. make sure my cat gets fed." her boyfriend stops by daily, revving his v8 junker and honking untill she comes out. I've made two 911 calls, once because he was raising his fist @ my bro. and also when he walked into my house after screaming in the windows from the porch. as i see it she's bringing disturbance to our home by giving him permission to come near the house. she claims that she can have whomever she wants over, simply because she paid rent. not to mention she's bothering the neighbors with loud arguments out side late at night. she claims once she's lived in rm. for certain time period renters rights take effect.
i really want to get control of this situation, but it is a bit complex and I can't seem to find a straight answer. If any one can give me specific advise on califonia laws i'd be really grateful.These are the questions i really need cleared up:
1. Should i bother with the $400 loan or cut my losses?
2. What process is required to evict someone that has not signed a contract? Do I need to file for 30 day? Is notice even required in this case?
3.What do I do if I fear that my personal belongings may be vandalized or stolen after notification?
4. can she hold any legal claim as resident to rights of room or house such as having visitors after a stay of 3 months? Can I refuse to allow these people into my house?
5.Can I get a restraining order against the boyfriend, whom my husband has known his whole life and lived downstairs from for 15 years?
6. What is the fastest and least dramatic way to take care of this problem?
