What is the name of your state (only U.S. law)? CA
This is the 1st time i've been inclined to seek legal advice. What I am writing about is a speeding ticket that I was given, and while most times I would pay the ticket. The few times I have been pulled over and ticketed I did deserve it and payed the price for it, this time I think it was unjust, want to fight it and want to know if i have a leg to stand on.
The scenario: While driving back home from the opening day of the local ski park, my cousin and I were driving home in a pack of cars(varying 6-10) for the majority of the ride. We were at the end/middle of this same pack of cars for most of the ride (70-100 mile ride) and we come over this ridge and see 4-5 CHP's parked there with at least 3 of them pointing their radar guns at the ridge. So of course, they decide to single my car out for whatever reason as I saw no other car from this pack pulled over (and we were getting passed as we all came across the speed trap).
The cop that pulls us over immediately asks if I had insurance (in a tone like he thought I wouldn't), I tell him that we were going with the flow of traffic as we were in a fairly tight pack for the trip home. The cop then proceeds to tell us that he wasn't even the one who "tracked us" and writes the ticket and the ticket says quote "approximately 88 mph". A bit upset and flustered I don't think to ask to see the gun read out (not sure if i have that right) and what proof that my car out of a pack of 6-10 cars is going 88 or whatever ridiculous speed they say I was going.
My cousin said when he noticed the CHPs he looked at my speed and noticed it between 65-70, and from my driving I know I'm not going to stay in a pack that's going 88 or similar speed. I remember that as we approached the ridge we slowed slightly but nothing so drastic as going from 90+ to down to 65-70 mph in such a short amount of time.
I guess what I'm asking for is advice on a course of action (hire a lawyer, what info to obtain or can obtain) or does it sounds like the CHP's fishing expedition claimed me and if I have any recourse. Thank you for reading and for any advice that can be offered.
