I live in Florida. I am a full time nursing student with a little over a year until graduation. I also work every weekend 2 twelve hour shifts. My ex totally supported my effort to better myself while we were together. Now he wants to claim that I am voluntarily underemployed and that the court should calculate the CS based on what I would be making if I worked full time. I am busting my butt raising two children, going to school 5 days/week and working 2. How will the courts see this? I will not object to having the child support modified after I graduate to reflect my new income and I will be making more than him when I get out! We had a verbal agreement when I started school that he would pay more of the bills (we were never married) and would watch the children every weekend for me to work. That lasted about a month when he decided that the kids took up to much of his "off" time. He has been voluntarily paying me $350/month since he moved out. (This is only for one child). The child support office calculated it to be $533 based on our current incomes. He thinks he shouldn't have to pay anymore bc I am "underemployed".
