Hi,

I'm hoping someone can answer a fairly simple question
...Is it required to obtain a "Legal Seperation" as a pre-amble to a Divorce in the state of California and if so what is the waiting period before you can file for the divorce...I know some states it is mandatory and some it is not. Thank you in advance for your help..!!

My response:

Legal Separation is not a preliminary requirement. You can go straight to the "BIG D" in California - - it's the "Check Box" right next to the check box for "Legal Separation".

There are only a couple of reasons why someone would rather have a Legal Separation than Divorce - - Religious reasons, and / or Tax reasons.
