Hi, I have been living in my apartment for 5 years along with my young son. I have had problems with my downstairs neighbor ever since he moved in 4 years ago. He complains of noise constantly, even during the day. He has also taken to making false allegations and calling the police even when there has been no noise whatsoever. (I believe he is trying to create a paper trail, due to threats that he was going to sue me). About 2 weeks ago the police came to my door at 9am on a Sunday because he complained my son was playing too loud, he was not loud enough to justify calling the police in my opinion. He also called the police this last Friday night at midnight saying that there was fighting in my apartment. That was a complete lie. I was getting ready for bed and my son was staying at his grandparents. This is just a small sample of the many things he has done.
I constantly feel like I am walking on eggshells in my own home. On the rare occassion that I have guests over, I spend most of my time telling them to shhhh. This is affecting MY right to enjoyment of my unit. I feel like I am being harrassed by him for these lies. I told the cops that I wanted him arrested for harassment, and they told me it was a civil matter. The prior landlord knew that he was full of crap and didn't pay attention to his complaints, however the new landlord is unfamiliar with this guys demeanor and wants to speak with me. I am worried that I will get evicted. My questions are...What can I do to protect myself and my son from this man? Can I make a "citizens arrest" for harassment? Would this fall under the definition of slander, and can I sue, if so in which court, and likely prevail? I have also been trying to find the city ordinances to acceptable noise levels in Concord, Ca and have had no luck, if anyone is able to point me in the right direction, I would appreciate it.
