We rented our place almost 2 years ago. We always paid our rent on time, the property manager told us if something broke just fix it and she'd deduct from our rent. We usually paid our rent 3-4 mos at a time and she was always fair on repair bills- which we did do quite a bit. whenever there was grafitti we painted, cleaned the yard, fixed the gate, the plumbing etc. About 2 mos ago a man came and told us that the property was owned by the bank and that they had been wrongly collecting rent from us. We showed him a copy of our lease, old bills, gave him all of our information including mailing address and phone numbers. He gave us a number of a bank, which when we called the number they didn't have record of the property. Our rent would have been due on 1/15 but the property manager never showed up (she had always picked up our rent. Also, about 2 weeks prior to the man coming by I had been trying to call her and the pager # we had for her was disconnected. Well last Sat. 1/13, I left for about 10 minutes and when I came back there were eviction papers on the gate. someone was home but no one had knocked or anything. It didn't name us it just said someone elses names and all does (which we had given him our names?). The strange part is it said that the bank had taken over 1/98 -two years ago. I don't understand why they didn't contact us especially since we were given the wrong number but also why did it take them so long to contact us at all. Do we have any rights? And are we liable for the rent to them that we paid to who we presumed was the property manager? And really we weren't given any reason to think differently. Do they have to give us time to find a new place? Someone had told me that since we were here over a year that they are required to give us some time? Please if anyone has any idea!

well this is what lawyers are for, to negotiate a deal, and to protect your rights......

If you paid rent to someone who you though was entitled to the rent, get all of your reciepts together....and if it was to the wrong person THE BANK has to collect the money from them not you.

Did you have any kind of a lease, or any reciepts for the rent and security.....I hope you never paid in cash!

So use the rent money TODAY and hire a lawyer.
