I was trying to buy a good digital camera and studied all the listings and finally decided on one product. I contacted one of the sellers via email and received an answer after two days with his phone number to call him. the proposed camera was a bundle deal with extra lenses and lots of additional stuff. Everything was advertised as brand new, never opened! The seller urged me to buy directly over the phone which I didn't do the first day, but on the second day. He promised that the item was in stock and will be shipped after two days. It took 14 days to get the camera and the package was ripped and very poor. The camera was open in a card box and wrapped in a plastic and some styrofoam. There was no manufacturers packaging, nor a UPC bar code or other indications that the camera was brand new. I don't know if the camera was returned, or repaired, or even stolen. It appears to me that the seller uses this tactic to advertise on ebay but prefers to make his sales on a privat basis, outside of ebay. I have no idea if he saves on commission this way too. When I contacted the seller, he said he made a mistake and I should send the camera back and he would send a new one. Since I already paid and it is his fault I refused to do so.
What is my best option? Thanks

The seller is offering the correct the problem and you don't want to give the the chance. That means you have absolutely no recourse.

Yep, and did you ever read that little side bar thing on Ebay that they post for every auction NOT TO AGREE TO ANY SALES OFFERED FOR THESE ITEMS PRIVATELY? Yes, he does them out of their money by doing this, and gets to screw you since you have no protection from Ebay, and no proof as to what you agreed to purchase and the details of said purchase.
