Camper vs Tree

My family and I were spend and enjoyable vacation week camping at Walt Disney World in March. During the stay we returned to the camp to find a 60 to 70 Foot oak tree blown down and fallen in the center of our POP-UP camper. Needless to say the camper was completely destroyed. We were able to salvage our personal belongings from the camper and camp site but the camper was to badly damaged to attempt to pull it home.

Walt Disney world saw to the demolition of the camper as well as arranged lodging for us for the remainder of the trip.

I am now seeking some compensation for the camper, which was 15 years old, and have been told by Walt Disney that they are not liable.

I did not have insurance on the camper. Do I have any recourse with them?

I have a couple of questions (and I have to admit that I am doing my best to not be laughing. I know this is not funny to you, but I have this picture of a Disney character huffing and puffing and blowing the tree down - picture Mickey or better yet, Goofey).

First, what was the value of the camper (and by that I mean what would you pay for a 15 year old pop up camper in the same condition your camper was in before meeting the tree)? What caused the tree to fall down? How long did you stay at the resort and in what kind of accomodations? Were you charged?

I admit it is funny, and consider the odds that a tree falls on a camper in a camp ground that contains 3000 camp sites.
Camper value I would place at around $1500. The day of the accident was windy and it appeared that the tree, a live oak apmx 30 inches in diameter, broke off around 2 feet above the ground. The root system did not give way. After the accident we were given accomodation at the camp ground in what is called a Wilderness Trailer. We stayed there 2 nights at Disney expense but were charged for the other 3 nights that we used the camp site prior to the "Fall".

Unless you believe that Disney did something wrong, this is one to put behind you. Any action would have to be brought in Florida and you would have to show that Disney did something wrong (e.g. trimmed the tree so that it was weaker, or failed to cut it down after it became aware that it was diseased).

Be thankful no one was hurt. Hope this helped answer your question.
