Can a breach of contract be theft?

Can we file criminal charges against individuals for theft if there is a contract involved?

We turned over $250,000 resale value of product over to a contractor to sell the product for us. We had a contract. They breached the contract by not giving us any money for sold items. But what we have later to find out is that the individuals intentionally took the product to steal what was quickest to sell and intentionally not pay us. Since it was intent to breach the contract as it was signed would this be theft?

Also to note, their advertisement initially stated that they were liscensed and bonded which turned out to not be true.

People don't file criminal charges. They report crimes and the authorities decide whether to prosecute.

This could very well amount to criminal fraud. Costs you nothing to report it to the authorities.

There could be both a criminal action (theft among other possible crimes) and a civil action (breach of contract among other possible claims) to pursue.

I suggest you report the contractor to the police and the police will investigate. Depending on the results of the investigation, the contractor might be charged with a crime or two,

You can also file a civil suit. Because of the amount of money involved, you should find an attorney to assist with the claim.

In addition, the state might be interested in the contractor's lack of licensing and false advertising claims. You could file a complaint with the Attorney General.
