Hello...

We live in PA -- my husband works in MD.

When we lived in GA in 1997, we purchased a truck. After we signed a contract and walked off the lot, the dealership sold the loan. It changed hands several times until the insurance company and I both did not know who held the loan.

I did not pay the first few months as I did not know the lein holder. I was contacted by a company that said they held the lein. I asked them to send me a contract that stated this so that I could be certain. The President was extremely nasty and said he did not have time to do that-- he was too busy......... Correct me if I am wrong, but this is a violation on his part for failing to disclose information...

Anyway, I told them to come get the truck, which we possessed for only a few months - if they were not going to show me a contract with their name on it, I was not going to pay. They did get the truck after several weeks.

On our credit report (both of our names were on the contract) .... in 1997, this company charged off this debt.

They have been on our backs since to come up with money that they say we owe them, and in which I hold no legal document with my signature on stating this fact.

Now they say they are going to garnish my husband's wages.
Can they do this after they charged this off as a bad debt and without sending me documentation on this vehichle?

Sorry to have written so much, but I need to know what our rights are.

I was wondering if a lawywer that sees this but does not reply could simply put a "no response" to this so that I do not have to constantly check my email or this board.

I need immediate help -- we were given tomorrow as a deadline and I am not sure what my options are. This is a first they mentioned garnished wages, and I need to know what my options are.

What state does this fall under? In GA, where we purchased the truck? Or PA, since we live here -- or MD, since this is where my husband works.

If they can't provide an original document with my signature, I feel that we have legal grounds for a recourse. I'd just like have some information regarding this --- but don't what state this falls under.

Thanks for those that took the time to look at my question.

I found another web site that guarantees a reply within 24 hours from professional lawyers. And I received the reply that I was hoping may come from here.( and in less than 12 hours)

How refreshing to have found this other site that actually lives up to their claims and statements.

You can imagine the sleepless nights that some may have waiting on answers that just never come. Luckily I searched around enough to not fall into that category.

You are possibly right about a few things -- but since I am a Moderator in another forum that gets just as much traffic as this site, if not more, means that I take my responsibility as a Moderator seriously. If I commit to something, I follow through with it. Yes, everyone is extremely busy, no doubt.

But this forum involves much more personal issues than most. For instance, how many people do you suppose have lost countless hours of sleep about issues (even though I was dealing with my situation for four years, wage garnishment was never mentioned - nor was I ever threatened with a one day deadline) People search the internet for answers to clear their mind as well as to gain collective information -- and some may need it immediately, through no fault of their own.

I was especially concerned to have perused the Abusive Forum only to find countless entries with no response. Imagine what these people must go through. This may not be a hot line, but people that post should get a response -- period. Every post should have an answer. If there are not enough people to keep up with the posting, there are countless solutions to this issue. There is nothing more irritating than to visit forums that just can not keep up with the demands. Forums are the craze but very few are well managed. Most leave it up to the visting people to work it out and maintain it at that.

I know that answers were directed to other posts after mine which meant mine was viewed(by a forum mod)but not answered. I don't mind receiving something as simple as "Sorry -- can not assist you." ... Since mine involved a time limitation, I not only posted to this forum but five others as well. I recieved an "immediate reply" from four.
(I received three after posting my previous message early this morning) Some from a site that was so huge that it is mind boggling how I could get an answer all the way to the others that had not as much traffic as this.

Not pointing a finger at anyone -- I am certainly not angry. I am just disappointed. As I said, these issues are much more involved than the average "how do I post my avatar?" ... and I just can't imagine leaving my forum issues, which are much less involved, unanswered.(Our site has over 20 forums and every answer gets a reply - we have five international forums which means 24 hours posting due to time zones -- this requres much more effort to maintain than most and we maintain high standards to benefit the users-- all get answered) This may be the only vehichle to get reliable information in any time frame for some people.

I'm sure by the looks of it, the few mods(lawyers,whatever you wish to call them)are probably over-extending themselves, which certainly accounts for the no responses in all of the forums. That is not fair to them, nor the people that come here to find reliable information. I guess that is the major point that I wish to establish.

As mentioned, I am fortunate to have found answers to my questions which makes me feel less stressed and more prepared in handling my situation.That's the feeling that everyone should have when visiting any forum with extreme and critical issues such as those addressed here.

You were not the one that did not get a response - it was I -- and I am grateful as I mentioned before to those that took the time to look -- perhaps they were looking for the unaswered question as well.
