What is the name of your state (only U.S. law)? NJ
My mother died 2 1/2 years ago, and we are finally coming to the end of the settlement.

The day my mother died, 2 of my older sisters started taking items from moms house, I stayed out of it.
My one sister, who lives in my dads VA house, took 2 bonds that my father bought for my son, and put them in her safety deposit box!

She had a change of heart last May, and told me that she gave my sister that lives in NJ to go get them, and to take them to our lawyer, to give back to my son. This was never done!
The VA sis is now back in NJ, and now refuses to do it. She isn't even the Executrix, my sis in FL is. And my sis in FL called our lawyer her consent to give the bonds back!

VA sis will not talk to any of us, she just send text messages:confused:
Anyway, I spoke with our lawyer this AM, also my sis in FL. Our lawyer asked whose name/names wher on the bonds. I told him that only my sons name was on there.
He told me that he would call my other sis in NJ, to contact the VA sis, and return the bonds.
VA sis and I exchanged texts alot today, and she tried to tell me that our lawyer was on jury duty! CRAZY, as I spoke to him in his office!
Now, my son wants to call the police, to get his bonds back. I told him not to do that.

My VA sisters last text said that our lawyer was on Jury Duty, which I find hard to believe! At that point, I turned off my cell phone, this is driving me crazy!

I would appreciate any advice that anyone could give me, to get this
matter settled.
Thank you very much!

Of course a lawyer can get called for jury duty. While it may be likely that one of the parties involved may decide they don't want a lawyer on the jury and preempt him, he's still got to show up. But if you spoke to the lawyer directly, you obviously know if that was a true statement or not.

Are the bonds in the son's name? If so, then they aren't really part of the estate. If they are in the deceased name, where are we in the probate process? What role does this "lawyer" have in the whole situation.

Thank you very much!

Thanks so much, FlyingRon, for replying to me.
The bonds are in my sons name only. This thing has been a nightmear, my sister that took the bonds from my parents house isn't the Executrix, the word "greed" comes to mind~and she put my sons bonds her safety deposit box at a local bank.
As far as the probate, that is done, right after my mother died, my sisters went to the County Court, and had the will probated. When I spoke to the lawyer yesterday, he said that he would contact my sister that has the bonds, and tell her to bring them to his office, so that they can be given back to my son. Problem is that she will not answer her phone! I offered to give him her cell phone number, but he said that he would rather avoid talking to her, so he will call my othere sister in NJ, for her to contact the VA sister, to tell her to bring the bonds to his office. (get the picture?)
The Bonds aren't worth to much, but thats not the point. They belong to my son, and he should have them back.
This is all so silly, my sister has been causing trouble for the past 2 1/2 years, even the lawyer is tired of her many phone calls, faxes, etc. I'm sorry for rambling on, I'm just fed up with everything, and just need to vent. This is affecting my health, and I seriously belive that the poor lawyer is on the verdge of a nervous breakdown. It is so sad that my family has fallen apart, because of greed! The will states a 4 way split, should have been easier to accomplish.
I just want this whole thing to end, and live in peace with my husband and 2 sons!
I truely apprciate any advice that you can give me.
My oldest sister that is the Executrix lives in FL, she is in contact with our lawyer by phone at least once a week. She has given him the authority to pay any bills that need to be paid. He is a very kind man, I don't want to bother him unless it is absolutely nessacary.

Call the police. Taking property you know doesn't belong to you and not restoring to the rightful owner is a criminal offense. Perhaps a kindly nudge from the local constabulary will get her to take some action.

Are we talking about savings bonds here? If so, then do not worry. She will not be able to redeem the bonds if they are not in her name. Only your son will be able to do that.

Thank you all!

I did not have to call the police, because of all of your help, thebonds are now at the lawyers office, waiting to be picked up by my son.
It is so unfortunatte that things like this take place upon a death of parents. Now, all 3 of my sisters are mad at me, for posting this!
Still, I am very gratefull to all that replied, it helped me to get the job done! I'm just sad that my sisters are so mean.
Thank you all so much!
