A few years ago, I was in an accident. I was hospitalized briefly, and ended up in a rehabilitation facility for a few months. I spoke with the tow company that was called by the Sturbridge police to take my totaled vehicle, and asked them to salvage it/ and keep the money to pay for the towing fees... In the few months I was in the rehab facility, the tow company kept my car on their lot.

I went to renew my license in March, and was told I had an "abandoned vehicle " I had to take care of before I could renew my license. They instructed me to goto the town hall in Sturbridge, MA, where I am from, and talk to them about clearing it up. I spoke with the town hall, and they told me they won't clear it up until I pay the tow company. I call the tow company,. And they tell me I owe $6900.00 for "storage fees" for a car I paid $1200.00 for! The owner of the tow company knows that I'm in a bind, will NOT take a penny lower than what's owed, and refuses to help me set up a monthly payment plan. I explained to him that I am a caretaker for my mother who was diagnosed with ALS a few years ago, and I have to drive her to her Dr's appointments just about every week.
I know for a fact that he does this all the time, a good friend of mine went thru the same thing about five years ago with the same gentleman. I tried to read the laws in MA when it comes to an abandoned vehicle, but I don't really know what to do next. Something feels SO wrong with this whole situation. So, PLZ, can someone out there point me in the right direction?? I figured I would goto the town hall, pay a fine, and then I could renew my license... I also wonder why the town let's this company tow a vehicle and then charge fees up to 10 times the value of it?? Thanks for taking the time to read my story... My family and I are grateful for any advice we can get on this matter...

Apparently they can since they did, although indirectly.

Months (years??) of storage fees plus the original tow charge add up fast. You can try speaking to someone at the local police department - they may be involved in licensing the two company somehow - about whether or not this was a misunderstanding.

How did you communicate with the tow company when you were hospitalized/in rehab?

If they did not follow ALL of the proper procedures when towing and storing your car, they may be in violation of the Massachusetts Consumer Protection statute (MGL 93A)

I suggest you go to the court website and see if this tow company has ever been sued. Contact the lawyer that sued them and see if he or she is willing to take your case.

The website is Masscourts.org. You will want to select the District Court division, and choose Dudley District Court. Search for the towing company name. You'll see any district court suits as well as any small claims suits.
