I have a Tenant. He claims that mildew damage some of this clothing. We ofter to fix the source fo the mildew damage right away. He has declined to allow us to fix the source of his mildew problem for over a month.

It is rent time again and he as brough this up again. My question in California. I know you could withhold rent if the landlord did not fix a problem in a reasonable time (in our case we offer to fix it right away, he did not allow us to fix it). I said we will not pay for his damage clothing (I have a valid legal defence for not pay for the damage clothing and I think he is making it up trying to blackmail us).

But, in California if a Landlord damage your property and he refuse to pay is that a valid defense against an eviction.

What will these renters think up next? the refridge is not cold enough and i got sick from drinking the milk, and it's your at fault for having a crummy refridge in the apartment?

Tell them the rent is due on time and in full, and they as responsible tenants MUST have renters insurance and let them file a claim with their insurance company and they will deal with your homowners insurance company.

then plan to evict them.
