I was rear-ended by a drunk driver, and the body shop told me that my car should be totaled with the cost of new parts and labor. The insurance adjustor for the drunk drivers insurance company gave me an estimate using used parts ( the rear half of a car from a junk yard), which keeps from totaling my car. My car was in prestine condition before the accident and had never been wrecked before. Under articles given by the Texas Insurance Commission I have the right to refuse the use of used parts. The Insurance company is telling me different. What are my rights.
