Can BioMom legally use stepdads name for kids?

Bio father lives in Texas, but his children and their bio mother live in Iowa with stepfather. Visitation and custody were decided in Iowa courts. Children are ages 10 and 11. Bio father shares joint legal custody.

Both children's legal last name is biofather's. We recently discovered that the children are using bio fathers last name hyphanated with stepfathers last name at school (a small private school), in little league, and junior football. Son's jersey is labelled this way, too. Biomom and stepdad also set up email account for each child with children's first initials and stepdads full last name only.

Is this legal? How would a court view this?

A court would most likely order her to use the children's legal last name only....at least for school purposes. The email account probably is irrelevant.

no she cant legally use stepdad's name for kids he isnt their father

the kids shouldnt be using stepdad's last name for anything-he is NOT their father.i dont care wether the name is hyphenated or not,they have no right to use the stepdad's name when he number one hasnt asked the bio dad's permission, number two, he, meaning the stepdad, did not adopt them.

Thank you for your replies. I was thinking along the same lines as both LdiJ and titansfan. However, I don't necessarily think the email is completely irrelevant since it obviously shows the alientation tactics that have been going on.

She denied our summer visit, and now is trying to deny x-mas so it looks as if we might have to end up in court again. :(

If we do, I will post again here to let people know how the court views the stepdad name thing.

YES THEY CAN LEGALLY YOU CAN CHANGE YOUR NAME TO WHATEVER YOU WANT!!! WHENEVER YOU WANT!!! :)

Google is your friend. The mother of these children cannot just change the names of the children to her husbands name. The father has every right to contest this. If he will not allow it, then there will be a hearing and then the judge gets to decide.

You may be thinking of an adult, then you would be correct.
