can ex get us for back child support?

My husband and I have been married for almost 5 years now. His ex-wife has custody of his daughter. He was ordered by the courts to pay monthly child support. Since the time of thier divorce, my husband has never paid CS thru the courts as ordered. The ex-wife has been fine with this arrangment. Since I came into the picture in 1996, we have always paid her every month by personal check. I have just lost my job and we haven't been able to pay his ex-wife the CS for this month and last month. She is now threatening to file for back child support if we don't find a way to pay her. Is there anything we can do? If she accepts payment as she has for the past 6-7 years, can she now come back and try this? And what about all that money we have paid since I married him? Is that all down the drain??
Please help if you can!

If, over the last 5 years he was court ordered to pay 300 a month, then as of today, he had better have proof that he has paid 18,000. He currently owes anything less that 18k and she can go to court to get this.


What many people fail to realise, is that any future decisions they make have to ensure they can still pay for everything AND CS on their own. The fact that YOU lost your job is irrelevant, he should still be able to pay the amount. If HE lost his job, then he can petition the courts to suspend or reduce the amount for a short time.
