What is the name of your state (only U.S. law)? FL
This is somewhat complex and not sure if proper forum location to start.
My father passed away about 2 1/2 years ago. He lived in Poland where I am from. I am the only child and parents divorced over 20 years. At first no one knew about a Will being left behind, then it surfaced. The will left everything to his girlfriend of 15 years. However since she owed the Polish IRS over $3mil she could not collect the money as the IRS would tax it all from her. After 2 years of talking, we sold the real estate (about 1.5mil USD) and she recieved 25% of the money at closing. There is still a pending lawsuit with the city for $250K USD and another property to sell in Poland worth about $400K USD. The lawsuit will take about 3 more years to collect, it is money due from when they took part of the land away to create roads and walkways and my father never filed his claim which he is entitled too so I had to file it.
Now in April I sold most of the properties, assets and we parted ways with her 25% going to her in cash and I deposited 75% in banks over there, waiting on exchange rates to get better and not needing the money. With an IRS lien she could never go after me or place money in bank account. However I found out she is now getting her IRS lien wiped there. You can plead insanity and it is over 15yrs old. Once wiped she can win lottery and IRS will not care. She is threatening to go after the money I already claimed by showing the WILL now, plus the other property which is scheduled to be sold mid 2010. It is owned with 38 other investors.
I plan on flying out this weekend and get the money out of the banks there, close the accounts and do my search for other funds in other banks my father might of had laying around. Banking is much different there from here.
Mainly, can she use that WILL to sue me for the money I have already. She refused to sign a waiver when we made the first deal. Being in the USA, will the money I have be safe? It is more of an international law question.
Also anyone know of ways for protecting the assets over there now I like to cash in on. I was never in hurry to sell as I wanted all this money to go for my kids anyway but there is no way I want her to have it how she treated me and alienated my father from me.
