can ex-wife change her mind?

I live in North Carolina. My husband was married for 15 years to his first wife. In December of 1997 their divorce was final. In June of 1998 his ex-wife sent him a notarized letter stating she was happy with the settlement and would seek no more compensation from him. Recently she sent him a letter stating now she is not happy with her settlement and may take him to court for more money.She also stated, her lawyer told her that due to the length of their marriage, she is still entittled to his pension and 401k in the event of his death. She was granted a part of his 401k as part of their divorce settlement. She also states, my husband had no legal right to change his beneficiary to my name. Is this true? How can I protect myself from her claims in the unfortunate event of my husband's death?

Well it sounds like she is jealios of your marriage to her x-husband .Keep in mine i am not a lawyer. But I think once you are legally divorced she has no rights to his pension or 401k . She got what she was going to get in court . They have been divorced for 3 yrs. The only thing she can take him to court for is cs(child support). If she was not happy with her settlement she should have never signed those papers . So a judge is going to look at the fact they have been divorced for 3 years . so he will look at that she is greedy and jealios . I do not believe you have anything to worry about.

Sorry for all the typos!!! jealious!! Anyway you are his new wife now so any event of his death the insurance will go to you. Make sure you are the beneficiary . Did you ask her if she dies where will her insurance money go to ? I bet it want be to her x-husband. i feel like she is envy of you alls marriage . So you will probably have trouble out of her until her wounds are healed. But I do not feel like she can go back and get any more from him than what she got . Think about it if every x-wife can take an x-husband back to court for more settlement money after years of divorce our court system will be over loaded. She has to face the fact that she is no longer entitle to anything of his now , you are.
