I live in North Carolina. My husband was married for 15 years to his first wife. In December of 1997 their divorce was final. In June of 1998 his ex-wife sent him a notarized letter stating she was happy with the settlement and would seek no more compensation from him. Recently she sent him a letter stating now she is not happy with her settlement and may take him to court for more money. She also stated, her lawyer told her that due to the length of their marriage, she is still entittled to his pension and 401k in the event of his death. She was granted a part of his 401k as part of their divorce settlement. She also states, my husband had no legal right to change his beneficiary to my name. Is this true? How can I protect myself from her claims in the unfortunate event of my husband's death?
