21 yr old male and 15 yr old female are dating and now pregnant together. Parents of girl don’t like that it happened but are supportive of the couple and them starting their life together. Parent do not want charges filed on the boyfriend as it will effect his ability to keep good jobs to provide for the girl and the baby.
Someone called DCF and reported Statutory Rape. DCF investigated but advised since parents are involved and is a good home they will not take action. However Duval County detective keeps interrogating girl and her family in pursuit of rape charges on the 21 yr old boyfriend. 15 yr old girl advised detective that she does not know who father is. Detective states that when baby is born they will be forced to do a DNA test to prove baby is not the 21 yr olds child. He says if the DNA proves positive, boyfriend will be charged with rape.
Baby is almost due to be born and they wish to get married. If the two get married before baby is born, can FL pursue this rape charge on the boyfriend?
If so, would the girl moving to another State with family help the situation for the boyfriend in FL... considering the girl and baby are then not available in FL for DNA testing.

We have considered moving her and baby to family member in GA.... but not sure if that will help the situation in FL.
Really? What kind of concerned friend are you that "you" were considering moving a minor child out of state to evade DNA testing on the baby? You do understand that an adult legally raped this barely pubescent child?

Florida does allow marriage under the age of 18 if the girl is pregnant, parents agree and Judge signs off.
As of July 1st, Florida law does not allow anyone under the age of 17 to marry and seventeen year olds can only marry if the person they are marrying is no more than two years older.

Prior to the enactment of this new law, pregnant girls of any age could marry an adult of any age with parental permission and a judge's approval. That is no longer the law.

What can happen when the young girl gives birth is that the 21 year old father of the child can be arrested and charged with rape.
