In March 2004 my boyfriend gave me $7,300 to pay off credit card and other debt. Rather than take out a loan from a bank he gave me the money we were supposed to open a joint savings account and I would make installments (like a loan) then we would go on vacation together. Nothing was signed it was all done verbally. We seperated after 17 1/2 years (we never married only lived together ) in May and he is now taking me to court to collect the $7,300. Can he do this since nothing was signed, we never set up a joint account?

Yes he can sue you for the amount, whether he would win is up to the judge... I would say he has a chance for winning as it is a substantial amount and if he can prove that you took it and put it in your account, you lose...

I did deposit the money in my account and paid off debt. Nothing was signed that stated I would make payments it was all verbal. I now live in IA working part time @ $11.18/hr. he makes well over $100,000/yr. It could take a while to collect if it is in his favor.

I would be collecting documentation showing what you did with this money.

He can win if he can prove you agreed to pay him back, a verbal contract is just as binding as a written one, just much harder to prove. How much you make & he makes doesn't matter. If you had taken a loan from a bank to pay the debt, would it matter how much money the bank had & how little you had!! If he wins a judgement, he could garnish your wages for as long as it take to repay him and as long as the judgment is still valid. Many states allow judgments to stand for 15 or 20 years.
