Can he get a restraining order???

Went to a local bar and said some insulting things about an ex-boyfriend (Basically that he was a jerk!).Someone who was there who knows him told him later that night what I said. He called me at 3am and told me that he spoke with his lawyer and that he is getting a restraining order against me for slander. I do not call or in any way contact him (I actually leave places if he arrives). Can he do this? What can I do to fight this?

A judge would not grant a request for a restraining order if all he has is that someone told him you said bad things about him. To get a restraining order, he would have to show that you are harasssing (calling repeatedly, going by his house, etc.), threatening him, or being violent toward him.

Just make sure that if you are served to go to court for a restraining order, you show up to defend yourself. I got a restraining order against my ex and had to make statements in the papers as to why the order should be granted. My statements were valid, but the court still needed to hear my ex's side. If he hadn't shown up, it would've been like he was admitting to guilt.

Today anyone can get a restraining order just for applying for it.
I had a restraining order placed against me for wishing my x boyfriend "happy Birthday" via e-mail. And he even replyed and said "Thank You..." but in court he pretended to be so put out by it that the "commissioner" granted it for 3 years. he lied and made up things and didn't even have to prove a thing.
Things to know... you have the right to have it heard by a JUDGE instead of a commissioner... exercise that right.... you have 60 days to file an appeal.... may vary state to state check. i did not know that either. I also asked about it on this site and no one ever mentioned that i could appeal it. If you can afford an atty get one. or see if you can have him pay for the atty if you win.
Fight it, sitck up for yourself. The creep who put one against me is known for stalking women in Venice and Santa Monica CA. I'm writing a book about it...
