Can he make me stay???

i live in wisconsin and am planning to move to indiana.asa of yesterday,i have informed my sons dad and the courts by sending a certified letter like i was soppouse to do.my sons dad now has 14 days left to object to my move.what i want to know,is there any chance that i will not be able to move,if he does object?this move is very important to my 6 year old son and i dont want him to be disappointed if we cant move.his dad hasent had very much contact with him in the past 6 months and my son dosent even call him"dad"anymore.I want more then anything to be able to move.Is there any chance that my ex will be able to keep me in wisconsin,and if so ---what are his chances?

Of course he can object to the move.. and it would delay your move while it went to court. With the details given he would probably not be successful, but it will stop you from leaving in 14 days if he gets you served in time.

i know that he can object,i had to give my ex and the courts 60 days notice befor i moved,my ex only had 15 days from the date of my letter to object,it is now 12 days.i guess what i really wanted to know is can the courts keep me in wisconsin at all because of him objecting?i have good reasons to leave the state and start my life over as well as my sons.and if my ex does object,how long befor i know that i will have to go to court?does it only take a couple days to serve me?and what if he dosent object,then am i free to leave?

don't know the specifics for your state on time frames, but after my ex contested my move i had 14 days to respond to his motion. a date was then established - convenient to his lawyer, mine, the judges and the GAL. it was 2 months after i was served with the motion to keep me there. it has been rescheduled on two seperate occasions. i am scheduled for this month. it has almost been 6 months since i was served.

it's not so much that the state can make you stay there, it's more a case that the state can make the child stay there. you would still be free to move, it's the child who may not be able to.

how fast you get served depends on the court systems. a good lawyer can push a complaint through and get it filed on the last day. it has to be filed within the time limit.

you will have to prove that it is an improvement of the quality of life for you and the child to move. you also have to prove that realistically the dad will still have a relationship and a chance at visitation with the child. someone will have to pick up the expense for the visitation and it is usually the parent that wants to move. how affordable will that be?

if you ex doesn't file a motion to stop you within the allowed time then yes, you are free to move with the child.

Hi I really feel for you I am going through the same situation now and I have found out that yes.... the court can prolong your move if he files in time. It is a very long and stressful time (as if you do not have enough stress already) I have asked for advice too so if I get any rsponses I will pass them on to you. In the mean time keep your head up and I will say a prayer for you. Good Luck
