I live in the state of Missouri. My husband and I are seperated, and getting divorced. He cheated, and fathered a child by the OW (DNA has proved this.) Can he ask for the amount in my 401K program to be divided between us? What can he ask for and get in court, considering that there is DNA proof of his infidelity? His mother is giving him very bad advice, and is trying to convince him that a car I bought before we married is marital property, and I figure she will have him go after the retirement money as well. Is my retirement account safe, or should I worry, considering the grounds for divorce I have against him?

We were married in 1997. We seperated in July 99. We did try to work things out, but right before Christmas 2000, he said he didn't want to try anymore.
