My husband said he is going to get a subpeona to get all of my past emails and instant messaging conversations. Can he do that?

Well yes he can.. but that is why they make a delete key..

I too am going through the same thing, and would like to know some of the same answers, I have heard that, even if you delete, there is still ways of getting these e-mails and instant messages, i have been told also that you can hire someone to clean out your computer, but if they already have the info it wont do you any good, im afraid that mine has already been hacked into, but im not sure. I wish there was a way of telling if they had, for both of our sakes. good luck to you, I know where your at!!! I have also posted a question too, welcome to read it!! sincerely lils mom

yes the items are all delted already. my question was about past emails that are supposedly held on the servers even though I delete them

1. Few ISP's backup emails and even if they did, they would only be kept for a short while
2. Few ISP's will be willing to just hand over there information. It would look very bad on them.
3. Even if they do hand over anything, it will be in raw backup form, therefore it will be up to your ex to hire a very expensive company to restore the data and to find your emails.
4. He needs a good reason to subpeona the information in the first place. You think it is easy to get a judge to order a company to hand over data just because there might be evidence there ?? He needs a very VERY good reason.
