can i be sued for libel?

I recently emailed a party who works for a nursing home and i made the statement in the course of lengthy negotiations that have been stalled by them, that "i know they have been busy since they were handed a corporate integrity agreement by the OIG"

I have been trying to obtain an agreement from this same party for over a year now that the OIG requires to be in place for us to do business with them.

I was emailed back a nasty response from this party threatening action etc b/c of what I said to them - i did not post my email anywhere and i said it came from a source I read which is true (the OIG website) - in the interim i discovered that it was a snf that was under an agreement with the OIG, that we do business with, but it was not this particular one, I confused the two facilities, I have not dislcosed that yet to them - but I did send an apology for anything they interpreted as a threat or accusation, but stated that they are under violation of the OIG for non - compliance because they have not executed and agreement with us in the 14 months that I have been trying to obtain one from them, thus putting our facility under potential violation as well for potential fraud if there ever was an investigation by the OIG into their facilities billing practices or ours. This is also an act that has been in place for SNF's since 1997, so it should not be anything new to them.

So, since the email was between myself and this same party and I said it based on what I thought to be true and I did not post it or disclose it to anyone else, can I be sued.

I believe the person wrote that back - who happens to be an attorney, because he dropped the ball for a long time and we repeatedly kept requesting them to comply, so he probably had to answer for why it took so long and had to then lash out at me for this.

I appreciate any help you can offer.

Can you be sued for libel? Sure you can. Anyone can sue anyone for just about anything these days.

Will they win? Doubtful. Slander, defemation and libel all require the transmission of the message to a third party. That does not seem to be the case here, based solely on the facts you presented.
