Can I be sued if I sold a frame listed as having clean title without the title?

I sold a frame to a motorcycle and listed it as a frame that has a clean title but never stated it came with the title. Now the person who bought it wants their money back? They said they ran the vin and its stolen and they are going to turn me in for fraud but it is not stolen and has been verified through the National Insurance Crime Bureau. So does this person really have a case against me?

they might. If they were told it is stolen, and whomever told them is right, they most definitely have case against you.

So, when the sue you, you take your evidence to court and they can bring theirs and the judge will decide whose is correct. That person will win.

The frame isn't stolen though...its been verified by the DMV and the National Crime Insurance Bureau. So would they still have a case?

it doesn't matter if he has a case or not. He can sue you. Isn't that what you asked originally? (hint: yes, it is)


so, if you do not believe him, tell him to get lost and if he wants to sue, go ahead and sue. Since you have proof it isn't stolen, you shouldn't have anything to worry about.

You do have actual proof you can present in court, right?

They probably do have a case. When you say something has a "clean title" it is presumed that you'll get it too unless you specifically said otherwise. Besides, if they can't get the title, IT'S NOT CLEAN. Further there may be state law that is against you (which if you'd have ANSWERED the question that is inserted in your first post rather that deleting we could help).
